Diddy prosecution will not pursue attempted arson and kidnapping theories

Both prosecution and defence rested their cases in the racketeering trial of the rap mogul this week.

Federal prosecutors in the Diddy racketeering trial are “no longer planning to proceed” with theories of attempted kidnapping, attempted arson, and aiding and abetting sex trafficking, according to documents reviewed by The FADER.

The racketeering case as a whole will proceed against the rap mogul, who also faces charges of sex trafficking and transportation to engage in prostitution related to an anonymous accuser and Cassie Ventura, Diddy’s former partner of 10 years. He has pleaded not guilty.

In a letter filed on Tuesday, June 24, prosecutors told Judge Arun Subramanian that they had “removed instructions from the charge” pertaining to the theories. “The Government is no longer planning to proceed on these theories of liability so instructions are no longer necessary.”

The attempted arson allegation stemmed from an incident involving Kid Cudi, the rapper and producer born Scott Mescudi. Cudi alleged that his Porsche was severely damaged by a Molotov cocktail while it sat in the driveway of his home soon after Diddy learned that he had been dating Ventura.

The prosecution and defence meet on Wednesday (June 25) to discuss jury instructions. Closing arguments for the trial will begin on June 26. Diddy’s defence team rested its case this week after declining to call any witnesses, or having Combs testify in his defence.
